clouds are increasing but is there any rain in this forecast? many bay area seafood lovers have been crabby this holiday season. how things could change this holiday season. good morning, everybody i'm brian flores. it's friday december 28th. >> and i'm claudine wong. steve, you medical examinerred the cold. you mentioned the rain. who needs to bring that umbrella today? >> anybody in the north or along the coast. how is that? >> that is good. [ laughter ] >> we have a system coming in. it's a weak system. still every system that is coming in has been producing some kind of rain. it's a much weaker system. a lot of cloud cover in advance of that. it will be cloudy and cold today for some. here is tara. thanks, steve. this is a look at the bay bridge toll plaza. and 280 in san jose traffic looking good near ray street.

let's head back to the desk. we begin with breaking news and a violent couple hours in oakland. three people were killed in two separate incidents. a double shooting and a stabbing. alex savidge is live on walnut street where a woman was killed a few hours ago. >> this is still an active crime scene for oakland police. what they found here this morning was a woman that was stabbed to death. it's all playing out. the crime scene located inside this apartment building that is up the road here from us on the right hand side. you can see at least one squad car is parked outside. we want to show you video we shot in the last half hour. woman's body was found inside the second floor unit. this all began according to a sergeant when a neighborhood called 911 around 2:30 this morning. officers arrived and found a woman with multiple stab wounds. she eventually died here on scene. police have taken a man into

custody who may have been responsible for the killings but at this point the sergeant tells me the motive for this stabbing remains unclear. meantime on the other side of the city oakland police are piecing together a shooting that left two people dead. the gunfire in that case broke out at the 800 block of immediate. police are not releasing much information on the victims or what may have led up to that shooting. we do know before the latest killings oakland's homicide count stood at 127. that is already a five-year high. and now you are adding three more killings. two people shot to death. one person stabbed. here at this apartment complex. and a lot of work for oakland homicide investigators to do this morning. we'll be working to get information from them throughout the morning and bring it to you. for now live in oakland alex savidge. the search is on for whoever shot and critically

wounded a minnesota at a bart station. that man was shot at 6:50 last night. he was taken to john mere hospital with life threatening injuries. few hours later bart trains were held at the concord station because of a report of a man with a gun. the police activity did cause delays in both directions. the reports were not related to the earlier shooting and nothing was found so normal bart service resumed. people in the midwest and northeast are dealing with the aftermath of a huge winter storm. snowplows have been busy in maine where snow fell more more than 16 hours. in arkansas 200 people are without power because of the storm and it could be that way for a few days. the deaths of several people are being blamed on that storm. president obama has called congressional leaders from both parties to the white house today as a last ditch effort to avoid the fiscal cliff. president obama cut short his

hawaii vacation to return to washington. coming up at 5:15 the odds they will be able to come up with a deal were january 1st. the contra costa fire distribution has put together a meeting to discuss the closing of five district stations. they are in clayton, lafayette, martinez. the first meeting is on january 7th in lafayette. we have posted a list of times and locations of those meetings. the brawl that caused wide spread panic in a san francisco mall led to a loss in post christmas sales for business. they ran from the mall when they heard a noise that sounded like gunshots. police arrested three people. all the commotion led to a lock down and likely kept thousands of post christmas shoppers out of the mall. there is no estimate on how

much money businesses lost but analyst tell the sacramento breeze it's like -- sacramento bee it's likely a significant amount. janine de la vega is live for us in cupertino this morning. one of the places where a dui crack down starts today. >> reporter: that is right. starting tonight sheriffs deputies will be conducting a dui check point at an undisclosed intersection. which along here on stevens creek boulevard. that is one of many happening throughout the bay area tonight and through the weekend. the california highway patrol is already out checking for people celebrating the new years holiday a little too much and in fro mont police operated at dui check point last night and early into this morning. today state senator jerry hill will introduce a bill he hopes will cut down on drunk driving. he will require drunk drivers to install a blood alcohol test in their cars after their second dui conviction. people reacted to the new bill.

>> it's good to weigh out all the options. this is obviously something that could benefit. i'm all for it. as long as our liberties are not too over reaching. >> reporter: the device prevents the cars engine from starting if it detects a blood alcohol level that exceeds a preset limit. the check point will run through tonight and into until about 3:00 a.m. saturday morning. research shows that crashes involving alcohol are reduced by 20% if there is a dui check point that has operated that intersection often enough. reporting live from cupertino janine de la vega. the current crab shortage has made some folks well quite crabby. but things may be looking up for seafood lovers in the bay area. crab fishermen expect big hauls

officers have been injured in a shooting in new jersey. it happened inside the blaster township police headquarters around 5:30 a.m.. shots were fired inside the building. three officers were injured. one suffering from a nonlife threatening gunshot wound. scientists will be analyzing the dna of a -- adam lanza killed his mother and 20 children and six other adults before killing himself. experts say the genetic specialist will likely be looking for a mutation or abnormality that could increase the risk of aggressive or violent behavior. a new poll is showing how americans view the national rifle association. 54% of people have a favorable opinion of the group. 38% say they had an unfavorable

opinion. the poll was conducted among more than 1,000 adults with a march gin of error of plus or minus 4%. president is meeting today with con impressional leaders at the white house. kyla, good morning. >> reporter: president obama is rounding up the top four leaders in congress to meet at the white house. senate leaders harry reid and mitch mcconnell will be at that meeting scheduled for about seven hours from now. this could be their last chance to find terms they can all agree to. the president and senate got back to work yesterday. the house of representatives just got the call to return sunday night. a vote has been taken by monday or else automatic income tax increase will kick in on

tuesday. republican aid say their leaders might now get on board with that. even so there is economic proof that many americans still fear going over the fiscal cliff. i'll have more on that in my next update. live in washington kyla campbell ktvu channel 2 news. analysts say if the country goes over the fiscal shift it could send the economy back if into a recession. secretary of state hillary clinton is expected to return to work next week. a specksman for clinton says she continues to recooperate at home. doctors say clinton contracted a stomach virus earlier this month and became dehydrated and fainted. the sonoma county sheriffs office will continue its search today for a possible plane crash. an eyewitness reported seeing

smoke coming from a distressed aircraft in the hills. search crews combed that area but have found nothing. the military is investigating a fighter jet that went down near fresno know. the plane crashed during a routine training mission yesterday afternoon. that about 100 east of fresno. the jet was flying between 12,000 own 15,000 feet at the time of the emergency. and the pilot ejected safely. >> there are no new one. >> no one was hurt on the ground. time now 5:14. the city of san francisco has a new plan to increase pedestrian safety. starting earlier next year never schools and senior centers. their goal is to protect pedestrians by cracking down on drivers that speed and run red

depending on your point of view it's a symbol of every lasting love or vandalism. about 25 couples have hung padlocks on the main street bridge. it started with a couple celebrating their 30th anniversary in august. they got the idea at a similar landmark locked up by lovers around the world. >> i think it's charming i love it. it's a cute little thing people have done. >> it's very sweet. i think we need more not less. >> there is a sign that says cal trans owns that bridge and is going to remove the locks on february 1st but some couples

hope to convince cal tran and the town of los gatos to keep those locks of love up. more than 14,000 dock wores are threat -- workers are threatening to go on strike on monday. economic experts say a shut down even for a few days could cost the u.s. economy billions of dollars. two uc berkeley law students have been charged with animal cruelty in connection with an incident at a las vegas casino. 24-year-old ericway yarr. and justin dew she a are accused of decapitating an exotic bird at a las vegas casino. if president obama and congress are not able to avoid the fiscal cliff, people here in colorado will be especial lip hard hit-- people here in

california will be especially hard hit. higher sales taxes and income taxes on the top earners. the fiscal cliff would hit all of that. >> i don't know if there is a word to describe how mad the public is going to be. nobody is going to be happy to see that happen. >> if taxes go up on everybody; it will not be a happy time. i think that is what will happen. >> meanwhile the tax policy center says they will see their take home pay shrink just over 3.6%. at a time when people were mourning the horrible sandy hook shooting one new york woman took advantage of that sympathetic spirit by allegedly setting up a charity scam in connection to that tragedy. 37-year-old noel alba set up an internet scam claiming to be the aunt of six-year-old noah

pozner. no a's uncle says he is disgusted someone would do this. >> my nieces and i think of these scammers they are stealing from them. they are survivors of this tragedy. >> the fbi says four days after the school shooting all of the money was refunded to donors. alba the mother of two teens denies opening the fund and says someone hacked her facebook page. she faces up to five years in jail. residents in san francisco won't have to go very far to get rid of their christmas trees. the curb side collection will start next week. the annual christmas tree program -- officials say trees should be stripped of decorations and placed on the curb. the paramedics that helped deliver a baby on the side of a road say it was a wonderful

experience. it started about 3:00 in the morning on christmas day. paramedics were called because a woman was about to give birth. they couldn't get her to the hospital in time so the ambulance pulled over own the ma'am delivered a seven pound baby girl. >> this by far was the best christmas. everything worked out so well. it was such a positive happy experience. reaffirms why we do this job. >> this was the couples third child. the mother and baby are doing well. your time is 5:25. and traffic has been looking good so far. let's go out to tara to see if that is holding true right now. >> it is. it is holding true. that is the good news. you can pretty much get wherever you need to go this morning at this hour traffic looking great. let's take a live look at 280. you can see the headlights are northbound traffic on 280 as you make the drive toward santa clara. and 680 a lot more folks on the roadways. 5:25 let's head over to steve.

highway 24 through lafayette you can see that traffic on the right hand side there toward the caldecott tunnel westbound looking good. let's head over to the desk. the chp is clearing the scene of a deadly overnight crash. christien kafton is live at golf links road. >> reporter: we have new details on the investigation into that deadly crash in the last three minutes. we had investigators come up and ask us to turn off our lights. they say they need to turn off our lights because they will be driving over that hill and video taping trying to get a sense of what the view might have been for the driver involved in this deadly accident moments before that crash. you can see the silver bmw on the road and now taking a look at you can see the black lincoln. investigators say the bmw smash into that black lincoln and then tried to run from the police officers. california highway patrol tells us this started as a regular

stop. they say the driver of that bmw had been spotted speeding. the chp pulled the car over at 90th and bancroft and the officers were out of their patrol car approaching that bmw when the driver pulled a quick u-turn and sped away. the officers got back into their patrol car and began following the driver. according to the chp the drivers lost sight of that bmw momentarily and came over the heel here and came upon this deadly crash. the bmw is a high performance vehicle. capable of very rapid acceleration. no word on exactly how fast that vehicle was going before the crash. investigators say the bmw t- boned the lincoln. killing one woman inside. >> they caught up to the vehicle on 98th avenue. at which they saw the bmw had collided into a black lincoln. the driver of the bmw jumped out of the car and began

running along with his passenger. >> reporter: the chp says they were able to catch up to that driver and they were able to make a good id on him because they got a good look at him after they pulled him over. no sign of the passenger who was involved in that crash as well. that passenger in the silver bmw and no idea why they ran. drivers facing vehicle manslaughter charges. coming back to our live pictures you can see the silver bmw pictures. one question whether that bmw had been stolen. it had not been reported stolen. at this point one of the bigamist res for chp and oak -- one of the bigamist res for chp and oakland police why the driver sped off in the first place causing this deadly accident. we are live in oakland christien kafton ktvu channel 2 news. we continue to follow breaking news. violence overnight in oakland. three people were killed in a

span of just 90 minutes. there are two crime scenes. one in east oakland and one in west oakland. first let's go to the one around 1:00 a.m. where two people were shot to death. that happened near mead avenue. police have not released information on the victims or if there is a suspect in custody. around 2:30 this morning a woman was stabbed to death inside an apartment on walnut street. police do have a man in custody as a possible suspect in that case. but they are not commenting on his relationship to the victim. these three homicides push oakland's total this year to 130. there were 110 homicides in all of last year. ktvu alex savidge is fathering more-- is gathering more information. they have hired a former last angeles police chief as a consultant. bill is created with reducing crime in l.a. and new york city. now he will be developing strategies to reduce the violence in oakland. earlier this month the city agreed to have a court

appointed director oversee the police department to avoid a federal takeover. >> he will do whatever he needs to do to get a feel of oakland. obviously i will be meeting with him a lot. he will be meeting with community members. >> he is being paid $350,000 for his services. the city also plans to split oakland into five districts that will each be run by a captain. a victim of a hit and run crash says he has firsthand knowledge of the crime crisis in oakland. he's been stranded on 83rd street since 7:00 last night. the man says he drove more than 50-miles to visit his father in okay land-- in oakland. when he got here a truck slammed into his parked car. he spent the entire night asking oakland police for help. >> they said they had no eta. no officers available. highway patrol officer came and said it's not his location. he left me here abandoned on this street which is not a good

neighborhood. >> both the fire department and aaa told him they could not help because this was considered a crime scene. just hours ago ktvu contacted oakland police and confirmed they did not send anyone to the crime scene because they did not have enough officers. he can't get home and worried about his kids. a dui crack down starts today on bay area roads ahead of the new year. janine de la vega is live for us in cupertino. >> reporter: here along stevens creek boulevard santa clara sheriffs deputies will be holding a dui check point. they have not told us the intersection just yet. it's one of many check points happening tonight. the california highway patrol is already out checking for people celebrating the new years holiday a little too much. in fremont police operated a dui check point last night and early this morning. state senator jerry hill will

2 news. crowds will flock to downtown san francisco for new years celebrations and bay area transit agencies are gearing up for the large numbers. coming up at 5:45 what bart is doing to insure people have no excuse to drink and drive 37 san francisco muni riders won't have to pay a cent to get a ride today. the agency is offering free rides to celebrate 100 years in service. passengers can ride buses and light rails all without paying. muni did plan to charge 5 cents which was the price riders paid a century ago. so they are free and those rides will last through 5:00 a.m. tomorrow. >> got to love free. time now 5:37. let's go to tara. she is in for sal. how is it looking? >> everything is looking great so far so good for your friday morning. as we take a live look outside we request take a look at the roadways and show you what we're talking about here. this is highway 4 through the bay point pittsburgh area. those headlights there westbound as you make the drive toward concord. up next a look at the bay bridge span. you can see cars are flowing

in west oakland around 1 sam. around 2:30 a.m. a woman was stabbed to death in east oakland. president obama summoned congressional leaders to the white house today for a last ditch effort to stop the economy from going over the fiscal cliff. they only have until january 1st to avoid tax increases. >> highway patrol and local law enforcement agencies will be cracking down on drunk drivers this holiday weekend. there will be more patrols and extra dui check points all over the bay area. the contra costa county districts attorneys office is investigating two separate police shootings. the latest happened last night. officers were called to a chevron station around 6:40 last night. they saw a man pistol whip a woman. the two officers opened fire. the suspect was taken to the hospital where he is in critical condition this morning. the two officers have eight years of experience between

them. we are learning more about the walnut creek police shooting we first reported at this time yesterday. two officers responded to a 911 call from an apartment on creek side drive. the dispatcher heard screaming in the background. when officers arrived they found the suspect anthony armed with a weapon. stunned friends say he worked as a hairdresser and often meditated in his backyard. new york police are searching for the suspect who killed a man by pushing him in front of a moving subaqua -- subway train. witnesses say the woman believed to be in her 20s fled the station after the incident. this is the second time this month a man has been shoved to death on subway tracks in new york. russian children cannot be adopted by americans. russian's president -- there

are about three quarters of a million russian children not in the custody of their parents. the u.s. is the biggest destination for adoptive children from russian. retired general norman is being remembered as a straight talking commander. >> you're better trained, you're better equipped, you are better led believe it or not inseat of mre's you are better fed. [ laughter ] but most of all you're a hell of a lot tougher than they are. >> the 78-year-old general died yesterday in florida from complications from pneumonia. in 1991 they commanded the coalition of 40 countries. and president obama released a statement saying in part quote our prayers are with the family who can tonight now the legacy he will endure.

and former president george h.w. bush also offered his condolences. calling him in statement a true american patriot. the former president remains in the hospital being treated for a fever. he's unlikely to leave the hospital any time soon but he would tell well wishers to s ba closet. the mayor calls the most recent buy back a huge success. all together 2,000 firearms were turned in exchange for gift cards that included 75 assault weapons and two rocket launchers. although there was a great turnout mayor says there needs to be more done to curb gun violence. he's calling for a ban on assault weapons and closing loopholes in assault weapons laws. transportation safety security says -- coming up at 5:55 we will tell you how many

from a frozen lake in michigan after spending an hour and a half in the frigid waters. the trouble started when the 11- year-old hound fell through his wife. the owner fell in also when he tried to pull the dog out. rescue crews were able to get out to them and bring them on shore. neither suffered any serious injuries. a tornado has touched down in watsonville. no one was hurt but it did cause some damage to this greenhouse. the weather service says the twister only lasted for three minutes and traveled across barely populated farmland. this year sets the record for a number of firearms confiscated at u.s. airports. 1,527 guns were taken away and 1,295 of those were loaded. local law enforcement handles any arrests of people who are
